By accessing or using the AutoSage platform (autosage.co.uk), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the service.
1. About Us.
AutoSage is a garage management software platform operated by Poole Software Limited, a company registered in England and Wales (company number 10764310). Our registered address is Arrowsmith Court, Station Approach, Broadstone, Dorset, BH18 8AT.
2. The Service.
AutoSage provides cloud-based garage management software including, but not limited to, job tracking, technician diary scheduling, stock control, purchasing, accounts, and a mobile application. We reserve the right to modify, update, or discontinue any feature of the service at any time.
3. Accounts & Registration.
To use AutoSage you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being misused.
4. Subscriptions & Payment.
Access to AutoSage is provided on a subscription basis. Details of current pricing and plans are available on our website or by contacting our team. All fees are exclusive of VAT unless stated otherwise.
Payments are due in accordance with the terms of your chosen plan. We reserve the right to suspend access to the service if payments are overdue.
5. Acceptable Use.
You agree to use AutoSage only for lawful purposes and in accordance with these terms. You must not:
- Use the service in any way that breaches any applicable local, national, or international law or regulation;
- Attempt to gain unauthorised access to the service, other accounts, or any related systems or networks;
- Introduce viruses, malware, or any other harmful material;
- Use the service in a manner that could damage, disable, or impair its operation;
- Share your account credentials with unauthorised third parties.
6. Your Data.
You retain ownership of all data you enter into AutoSage. We will not access, use, or share your data except as necessary to provide the service, comply with the law, or as described in our Privacy Policy.
You are responsible for ensuring that any personal data you process through AutoSage complies with applicable data protection legislation, including the UK GDPR and the Data Protection Act 2018.
7. Intellectual Property.
All intellectual property rights in the AutoSage platform, including its software, design, logos, and content, belong to Poole Software Limited. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the service for your internal business purposes.
8. Service Availability.
We host AutoSage on the Microsoft Azure Cloud and aim to provide a reliable, highly available service. However, we do not guarantee uninterrupted access. From time to time, the service may be unavailable due to scheduled maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability.
To the fullest extent permitted by law, Poole Software Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of AutoSage. Our total liability to you for any claim arising from the service shall not exceed the fees you have paid to us in the twelve months preceding the claim.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.
10. Termination.
You may cancel your subscription at any time by contacting us. We may terminate or suspend your access to the service immediately if you breach these terms.
Upon termination, you may request a copy of your data within 30 days. After this period, we reserve the right to delete your data in accordance with our data retention policies.
11. Changes to These Terms.
We may update these Terms of Use from time to time. We will notify you of any material changes by email or through the platform. Your continued use of the service after such changes constitutes acceptance of the updated terms.
12. Governing Law.
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
